Driver's license suspended. Arcigay, good, but more courage.

  

ROME, 10 APR – A ruling that has a very positive aspect, even if "more courage could have been shown": this is what the national president of Arci saidgay, Paolo Patane', comments to ANSA on the confirmation on appeal of the convictions of the Ministries of Defense and Transport, in relation to the suspension of the driving license of a young Sicilian homosexual.
“"We must take the positive side of this confirmation," says Patane'. "Clearly, once again, the courts are acknowledging rights and protections that the legislature is still lacking. When, in a democracy, politics loses its effectiveness and the courts are forced to guarantee individuals what politics itself cannot, we face a problem.".
Regarding the specific case, according to Patane', "it's clear that the court's confirmation is a positive development, reinforcing the rights of a person who had suffered a glaring injustice for the damages he had endured for a period of his life." "Perhaps," he adds, "it would have been worthwhile to be truly courageous and confirm the amount of compensation, especially since this is an exemplary case. Perhaps, beyond the strictly economic issue, the nature of the case would require highlighting the seriousness of the incident with a high fine, including a financial one.".
“"Finally," he concludes, "the case confirms a trend: increasingly, courts in Italy are signaling a poor regulatory representation of social change. Society changes, but this doesn't translate into laws, protections, and rules, due to a disconnect between politics and society." (ANSA).
