Bologna, February 28, 2017 – "On the subject of parenthood, the ruling by the Trento Court of Appeal finally frees us from our obsession with biological matters and puts the interests of children back at the center," Gabriele Piazzoni commented on the historic ruling by the Trentino court that recognized full parenthood for a couple who had resorted to surrogacy. The judges expressed themselves clearly, literally accepting the parental bond described in the children's birth certificates, and stating that the parent-child bond is constituted not so much by a biological bond, but by the parents' desire to care for and raise a child, providing for their needs and assuming responsibility for their care. The Court recognized the right of those children to full protection of their bond with their parents, as their inalienable right. The legislature should reflect on this ruling and reflect on the need for a reform of family law that truly puts children back at the center, including those whose families are still partially invisible to the State. A reform that recognizes the complexity and multiplicity of family bonds, opening it up to all types of families capable of providing for the care of children, and freeing them from unjust judicial ordeals, which in many cases, and we hope from now on in all, merely reaffirm the goal that Parliament has not yet had the courage to achieve,“ concludes Piazzoni.
