On Saturday, April 14, Arcigay will take to the streets of Italy to raise a voice against parliamentarians who have remained inactive in the face of the important rulings of the Constitutional Court and the Court of Cassation. Their silence is not only a denial of rights, but also the now institutionalized cause of the violence the LGBT population suffers every day. In Turin, the meeting organized by the Arcigay Torino Ottavio Mai committee is at 4 pm in Piazza Castello in front of the Teatro Regio. …ENOUGH NOW! IT'S ONLY UP TO YOU Two years ago, the Constitutional Court, with ruling 138 of April 14, 2010, affirmed for the first time the constitutional dignity of same-sex couples, recognizing that any choice, behavior, or statement that impedes the possibility of being recognized with the same rights as heterosexual couples violates a fundamental right waiting to be fully realized. Two years later, the Court of Cassation, with ruling 4184 of 2012, recognized the right of same-sex couples to family life and "to receive treatment consistent with that guaranteed by law to married couples.". On February 13, 2012, the court of Reggio Emilia recognized the right of a Uruguayan citizen, homosexual and married to an Italian man in Spain, to enjoy a residence permit for family reasons, thus recognizing his status as spouse, albeit for the purposes of free movement. Also this year, the European Parliament, in its Resolution of 13 March 2012, firmly expressed its regret at "the adoption by some Member States of restrictive definitions of 'family', aimed at denying legal protection to same-sex couples and their children; it recalls that EU law is applied without discrimination on the basis of sex or sexual orientation, in accordance with the Charter of Fundamental Rights of the European Union.". Over the past two years, Europe, the Constitutional Court, the courts, universities, the mass media, businesses, civil society in general—and even some representatives of the Church and the Catholic world—have repeatedly reiterated that same-sex couples must be recognized as having the same rights as heterosexual couples. Equality of rights finds expression in only one place: CIVIL MARRIAGE FOR SAME-SEX COUPLES. Our equality is useful to the country because there is no democracy without equal rights. Allowing same-sex couples to enter civil marriage is a duty for every single parliamentarian. Dear Members of Parliament and Senators… ENOUGH IS ENOUGH! IT'S ONLY UP TO YOU. Respect the Constitutional Court's warning to intervene to recognize the rights of homosexual couples; Listen to the courts that find themselves having to fill a gap due to the lack of a law; Bring Italy to the Europe where civil rights also include the rights of families formed by homosexual people; Provide legal protection for same-sex couples and their children, who are still denied it today. Memberships: ARCIGAY, AGEDO, ARCLESBICA, CERTAIN RIGHTS, RAINBOW FAMILIES, LENFORD – LGBT LAWYERS, MIT, RGR
“"There is no respect without the recognition of equal social dignity and rights," says Marco Giusta, president of the committee, "and without respect, the ground is fertile for homophobia, intolerance, and violence. As already expressed in the title of this year's Turin Pride—"We don't want the moon, it's Europe that demands it"—our demands are not, as some would have it, alien to social reality or even unconstitutional. Rather, they are deeply rooted in the lives of thousands of people who, unable to access the institution of marriage, are unfairly discriminated against, as the recent ruling of the Court of Cassation has highlighted. Europe, too, constantly reminds us that the legislative vacuum regarding same-sex couples is a shortcoming that is making Italy increasingly backward in terms of rights. Our Constitution, in Article 3, states: <
Turin. Enough, now it's your turn.
