Families: The Constitutional Court mandates recognition of both mothers at birth in same-sex couples. Piazzoni (Arcigay) exults: "Now we need to reform Law 40."“

 

Bologna, May 22, 2025 – In a landmark decision, the Constitutional Court has ruled that female couples who have resorted to medically assisted procreation (MAP) abroad must be recognized as parents from the birth of their child. 

 

“"This ruling represents a historic turning point," commented Gabriele Piazzoni, Secretary General of Arcigay. "Finally, our Constitution embraces a broader and more inclusive concept of family. Thousands of boys and girls already living in Italy, and those yet to be born, will no longer have to endure the long and painful legal process required until now to have both their parents recognized. The Court has given voice to a social and cultural shift that has existed for years, but which politicians have ignored for too long, forcing many families into protracted legal battles to obtain fundamental rights.". 

 

“"A special thanks," Piazzoni continues, "goes to Rete Lenford and its president, attorney Vincenzo Miri, who tenaciously transformed years of struggle by the LGBTQIA+ movement into a solid and irrefutable legal victory. This result demonstrates that Italy can and must evolve, overcoming discrimination that has become anachronistic. Now, however, is the time to move forward: it is urgent to reform Law 40, removing the ban on access to assisted reproduction for female couples and single individuals. This restriction no longer has any justification other than to perpetuate unacceptable discrimination," Piazzoni concludes.
